General terms and conditions

Advocaten De Ganck is a civil partnership in the form of a private limited company under the name Advocaten Sociaal Recht – Gent and is located at 9000 Ghent, Molenaarsstraat 109. The company is registered in the Crossroads Bank for Enterprises under the number 0632.665.672.

The lawyers are members of the Bar Association at the bar of Ghent.

Unless otherwise agreed between the parties, the following conditions apply as monetary compensation for the services of Advocaten De Ganck to its clientele.

The fee is, as a rule, determined per hourly rate, which is established based on the importance and difficulty of the case, the achieved result, the experience, expertise, and knowledge in the subject matter of the handling lawyer, taking into account the financial capacity of the client.

The costs in a file, which relate to the case, are charged to the client via flat-rate costs and special costs:

• The flat-rate costs include costs for file creation, costs for domestic telephone and telefax + emails, costs for correspondence, both written and electronic, and typing, administration, and accounting costs;
• The special costs are specified separately and justified by amount. They include travel expenses, translation costs, extraordinary shipping costs, bailiff and expert costs, etc.

All amounts/rates are exclusive of VAT. The office charges the fees and costs with an invoice. During the processing and/or before starting a case, the office can charge partial settlements or advances to the client. A detail of the interventions performed by the office is added to the final settlement of a file. The invoices are payable within a month by deposit into the office’s bank account.

The extrajudicial dispute resolution is established by the Ghent bar. You can obtain more information about the characteristics and application conditions of this arrangement and the Arbitration rules via the website www.balie-gent.be.

The professional liability of the lawyers of the office is insured through the Order of Flemish Bars in the first rank at Amlin Europe nv (Koning Albert II-laan 9, 1210 Brussels) under policy number LXX034899 up to an amount of 1,250,000 euros per damage case. For the lawyer-partners, there is an additional insurance in the second rank at AG Insurance nv (E. Jacqmainlaan 53, 1000 Brussels) under policy number 99.551.935 up to an amount of 2,500,000.00 euros per lawyer and insurance year.
